Terms of service

This Terms of service is entered into by and between Victoriya Gulova - a self-employed individual operating under the personal brand MySpiritAnimalClub, hereinafter – the online store – provides the content available on the website and offers goods/services in accordance with the Terms of Use outlined below.

1. General Provisions

If the consumer purchases goods/services through the website, such a mutual agreement is considered a Distance Contract and is subject to the laws of the Republic of Latvia regulating distance contracts, including but not limited to the Consumer Rights Protection Law of the Republic of Latvia, the Cabinet of Ministers Regulations “Regulations Regarding Distance Contracts”, and others.

2. Making a Purchase

Product prices and specifications are indicated next to each product in the online store.

To place an order, add the desired products to the shopping cart. Fill in all the required fields and select the appropriate delivery method. The total cost of the order, including delivery, will then be displayed on the screen. Complete the purchase by making the payment to finalize the order.

3. Payment Terms

The currency used for payments on the website is Euro (EUR). For customers located in the United Kingdom, payments may be processed in British Pound Sterling (GBP), and for customers located in the United States, payments may be processed in United States Dollars (USD), depending on the selected payment method and provider.

Payments are processed via third-party payment service providers, including montanio.com (operated by Montonio Finance UAB), PayPal and Shopify Payments.

Montonio Finance UAB is a licensed payment institution incorporated in Lithuania, company registration number 305205122, with its registered address at Lvovo st. 25-702, Vilnius, Lithuania, and holding payment institution license No. LB002007 issued by the Bank of Lithuania.

Available payment methods:

• Latvian online banking payments: Swedbank, SEB, Citadele, Revolut and Luminor

• Card payments: Visa, Mastercard and American Express

• Payment platforms: PayPal, Google Pay, Apple Pay, Klarna and UnionPay

When using an online bank payment method, the Customer must confirm the payment and click the “Return to merchant” button to complete the order process.

Payments are processed securely by the respective payment service providers. The personal data necessary for payment processing is transferred to the selected payment provider in accordance with applicable data protection laws, including the General Data Protection Regulation (EU) 2016/679 (GDPR).

The sales contract is considered concluded upon successful confirmation of payment by the payment service provider.

If the Seller is unable to fulfil the order, the Customer will be notified without undue delay, and any payments received will be refunded as soon as possible, but no later than within 14 days from the date of notification.


 

4. Delivery Terms

Goods are delivered to the following countries: Austria, Belgium, Bulgaria, Croatia, Republic of Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, United Kingdom and United States. Purchased goods are delivered via USPS, FedEx, DPD, LatvijasPasts and DHL. All customs duties and taxes payable to receive the shipment at the destination are the responsibility of our Store. Delivery costs are displayed prior to order confirmation.

Purchased goods are delivered to the address specified by the Buyer within 2 – 11 working days. In exceptional cases, we reserve the right to deliver the goods within up to 45 calendar days, in which case the customer will be notified.

5. Right of Withdrawal

All of our products are made-to-order. This means each item is produced individually after the order is placed — not pre-manufactured or stocked.

Because of the custom nature of production, we do not accept returns or exchanges unless the item is defective or damaged upon arrival.

Any claims for misprinted/damaged/defective items must be submitted within 14 days after the product has been received. For packages lost in transit, all claims must be submitted no later than 14 days after the estimated delivery date. Claims deemed an error on our part are covered at our expense.

To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

Notification for EU consumers: According to Article 16(c) and (e) of the Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, the right of withdrawal may not be provided for:

1. the supply of goods that are made to the consumer's specifications or are clearly personalized;
2. sealed goods which were unsealed after delivery and thus aren't suitable for return due to health protection or hygiene reasons,

therefore MySpiritAnimalClub reserves rights to refuse returns at its sole discretion.

To exercise the right of withdrawal, you must send it to the email address: myspiritanimalclub.info@gmail.com within 14 days after receiving the goods.

The Buyer must return the goods to the Seller without undue delay, but no later than 14 days after sending the withdrawal form. Upon receiving the returned goods, the online store will refund all payments received from the Buyer under the Distance Contract without delay and no later than 14 days.

The Seller has the right to withhold the refund until the goods have been received or the Buyer has provided proof of return. If the Buyer chose a more expensive delivery method than the standard one offered by the store, the store is not obliged to reimburse the excess delivery costs.

The online store is not liable for delays or failure to fulfill obligations due to circumstances beyond its reasonable control.

The online store reserves the right to refuse to sell goods and to request the return of goods from the Buyer if the price indicated on the site is significantly lower than the market price due to an error.

6. Processing of Buyer’s Personal Data

The online store processes only those personal data that the Buyer enters when placing an order, such as name, surname, email, etc.

The online store transfers personal data to the delivery service provider(s) in order to ensure the delivery of goods.

If you have explicitly agreed to receive our marketing communications, including newsletters, we may occasionally contact you to provide information about our services and latest offers. For this purpose, we may process your email address provided at the time of subscribing to marketing communication.

The Buyer has the right to opt out of marketing communications at any time by notifying us via email: myspiritanimalclub.info@gmail.com.

7. Dispute Resolution

For matters not regulated in these Terms and Conditions, the Buyer and the Seller agree to follow the applicable legal acts of the Republic of Latvia.

All disputes between the Seller and the Buyer shall be resolved through mutual negotiations or correspondence. If resolution cannot be achieved in this manner, disputes shall be settled in the courts of the Republic of Latvia in accordance with Latvian law.

The Buyer also has the right to seek dispute resolution through the Consumer Rights Protection Centre or through the courts of the Republic of Latvia, or approach the European Union’s online dispute resolution platform.
